IMPORTANT NEWS We are attempting to inform you that recently the State Department released the Visa Bulletin for July 2007.The Visa Bulletin for July 2007, indicates that the visa numbers are CURRENT for all employement based categories, with the exception of the "Other Worker" category. This means that you may be eligible to file for an I-140 petition concurrently with the I-485 petition if you fall under one of the categories:
- You have an approved Labor Certification and no subsequent action has been taken;
- You have an aproved Labor Certification and also an Approved I-140 petition, but were unable to file for the Adjustment of Status, because the Visa numbers were not current for your priority date at the time;
- You have an approved Labor Certification and a pending I-140, but could not file for Adjustment of Status concurrently as the Visa numbers were not available for your priority date.
- In addition all those people who qualify for green card cases without labor certification, such as Schedule A (nurses and physical therapists) and "special category" cases. These include EB2 National Interest Waivers, previously retrogressed for nationals of China and India.
If you believe that you may fall into one of the above categories, and may be eligible to apply for Adjustment of Status, you should IMMEDIATELY BEGIN, your Adjustment of Status Process because the visa numbers/availability changes each month. But in any case the USCIS will not accpet these applications prior to July 2, 2007.
